Automated mobility is an increasingly important area in road transport primarily due to high accident rates caused by human failure, the need for inclusion, and the emergence of sustainable transport. Road transport makes a major contribution not only to getting from point A to point B but also has a significant impact on the economy and employment. The purpose of this paper is an analysis of the different legal approaches to the deployment of automated vehicles in Germany and Slovakia. This paper first gives a brief overview of the functional safety legislation of automated vehicles, then focuses on its market surveillance and the role of the driver in automated vehicles.
