The article addresses the question of the effects of the rulings of the Court of Justice of the European Union in the preliminary ruling procedure as a special type of procedure. The article reflects the question of the binding nature of the decisions thus issued, in particular with regard to the scope of bindingness itself, ie whether it is only the binding of the inter partes or the binding of erga omnes, or other scope of bindingness. Particular attention is paid to the field of public procurement and the importance of the preliminary ruling in this area of law.
