Procedural Aspects of the Administrative Offence of Vehicle Keeper

Abstract

The administrative offence of vehicle keeper, which is built on strict
liability, has been a part of the legal order of the Slovak Republic
for almost a decade. Despite this fact, the substantive and procedural
aspects of the offence have not been comprehensively examined. The
aim of this article is to follow up on the author’s previous findings in
the field of its substantive legal aspects and to concentrate the research
activity on its procedural legal aspects. The conclusions that will
emerge from this research activity should complete the basic theoretical
base of knowledge about the administrative offence of vehicle keeper
and at the same time should serve as a contribution to the discourse on
good application practice of inferring responsibility by the competent authorities,
inter alia by identifying regulatory gaps. and proposals for their solution.
